TERMS OF SERVICE

1. Contractual Relationship
Beach Belongings utilises the Yellowbox digital locking system and User-app within each of
it’s locker locations. Yellowbox provides a technology platform that enables users of its
mobile applications and websites (‘Applications’) to access and use Yellowbox’s storage
facilities (‘Services’).
By accessing or using any of the Applications or Services, you acknowledge that you have
read, understood and accepted the following terms and conditions and agree to be bound by
them. This agreement creates a contractual relationship between you, Beach Beach
Belongings and Yellowbox, and entitles you to use the Applications and Services. If you do
not agree to the following terms and conditions, you are not entitled to use access or use
any of these Applications or Services.
In agreement with the Terms & Conditions set by Yellowbox, Beach Belongings enables
Yellowbox the right to expressly terminate these terms or any services and may deny the
services or any portion, immediately, in the case where Yellowbox (and/or Beach
Belongings) reasonably suspects you have, or are likely to breach these Terms and
Conditions. Yellowbox may also expressly terminate these terms or any services and may
deny the services or any portion, on 30 days’ written notice to you, in the case where
Yellowbox terminates these Terms and Conditions or any Services for any reasonable
business, legal or regulatory reason.
Yellowbox and Beach Belongings reserve the rights to amend the following terms and
conditions or any other policies related to the Service at any time. If Yellowbox or Beach
Belongings make a material change to the terms and conditions or any other policies,
Yellowbox & Beach Belongings will provide appropriate notice under the circumstances.
Amendments to these terms will be effective when proper notice has been provided.
Continued access or use of the Applications and Services after an amendment notice has
been provided will constitute as acknowledgement, understanding and acceptable of the
amendments.
The acceptance of the user terms shall be deemed to include the acceptance of the privacy
policy (which is available online).
2. The Services
The Services constitute a technology platform that enables users of Yellowbox’s mobile
applications or websites provided as part of the Services (each, an “Application”) to provide
storage services.
Restrictions to service
Items prohibited by law or considered hazardous under Australian legislation, as well as
items which by their nature or packaging may cause harm to humans, to the environment or
to other luggage carried and/or stored, are not allowed for storage. Yellowbox and Beach
Belongings do not permit the storage of, nor provide different services for goods which at our
sole discretion are considered as hazardous or dangerous. Failure to abide by these terms
may result in the termination of service.
Yellowbox and Beach Belongings do not permit the storage of prohibited items, including, but
not limited to: plants and animals, alive or dead; material that can be considered as
pornographic or indecent; weapons (firearms and bladed weapons); software containing

information of high value; garbage; political material; hazardous materials; narcotic or
psychotropic drugs; and other perishable goods.
Third Party Services
The services provided by Yellowbox and Beach Belongings are to be made available or
accessed with other third-party services that Yellowbox and Beach Belongings do not
control. The consumer also acknowledges that varying terms of use and privacy policies
may apply to the uses of such third-party services. Beach Belongings (and Yellowbox) does
not endorse these services and in no extent will be responsible or liable for the services that
these parties provide. These third parties are not parties to this contract and are not
responsible for the provision or support of the service. The access to the services is set out
in the third-parties’ own terms of service.
Use of Services
In order to use most aspects of the Services, you must register for and uphold an active
personal user Services account. Registration of an account requires a submission of
personal information, such as your name, mobile phone number and email, as well as at
least one valid payment method (either a credit card or accepted payment partner) to
Yellowbox. You agree to uphold accurate, complete, and up-to-date information within your
Account. Your failure to uphold accurate, complete, and up-to-date Account information,
including having an invalid or expired payment method on file, may result in your inability to
access or use the Services. You incur all responsibility for all actions and activity that occurs
on your Account, and you agree to ensure the security and confidentiality of your Account
username and password at all times. You may only possess one Account, unless stated
otherwise as permitted by Yellowbox in writing.
Network Access
You are responsible for obtaining the data network access necessary to use the Services
offered by Beach Belongings via the Yellowbox App. Your mobile network’s data and
messaging rates and fees may apply if you access or use the Beach Belongings Services
and Yellowbox App from a wireless-enabled device and you shall be responsible for such
rates and fees. Beach Belongings and Yellowbox do not guarantee that the Services will
function on any specific devices. The Services and Yellowbox App required to access Beach
Belongings Locker units may be subject to malfunctions and delays inherent in the use of the
Internet.
Ownership of Property
The Beach Belongings applications and storage facilities are not sold or transferred to you,
and Beach Belongings retains ownership of all applications and storage facilities even after
installation and use.
3. Payment
The use of the services may result in charges for the services that have been provided by
Yellowbox and Beach Belongings. Directly following these services, Beach Belongings will
will facilitate the payment of the relevant charges which will be processed through the
Yellowbox user-app. These charges are due immediately and payment will be facilitated
using the preferred payment method established in the Account, in which the receipt will be
delivered to the customer by email. If the primary payment method is unable to be charged,

you agree that Yellowbox (and Beach Belongings) may use an alternative payment method
in the account if available.
Based on the contractual relation between the consumer, Beach Belongings & Yellowbox,
Beach Belongings & Yellowbox reserve the right to establish, remove and/or revise charges
for any or all services or goods obtained through the use of the services based on Beach
Belongings and Yellowbox’s sole discretion.
The consumer may be responsible for the cost of repair for damage to, or necessary
cleaning of Beach Belongings/ Yellowbox’s property as a direct result of usage of services
under the account in excess of normal ‘wear and tear’ damages and required cleaning. In
the event that such a need for repair and cleaning is required, Beach Belongings &
Yellowbox reserve the right to facilitate payment for the reasonable cost through the
designated payment method.
4. Disclaimers
While Beach Belongings takes great care to ensure lockers are completely safe and secure,
we are unable to guarantee or insure against break-ins or destructive vandalism. Beach
Belongings, Yellowbox and the location partner are not liable for any loss or damage to
property that is stored within the lockers during or after the provision of services. Beach
Belongings, Yellowbox and the location partner are also not liable in relation to any proven
damages that can be considered as a direct or indirect consequence of the damage or loss
of property that occurs from the service provided. In the event of a locker malfunction,
Yellowbox, Beach Belongings and the location partner will not be liable for any direct or
indirect losses to the customer or related parties.
It is the customer’s responsibility to ensure that all personal items are removed following the
end of the service. The customer must keep the inside of the locker clean and clear of
rubbish. Beach Belongings, Yellowbox and the location partner are not liable for indirect,
incidental, special, exemplary, punitive or consequential damages as a result from the use of
the services that are provided. Beach Belongings, Yellowbox and the location partner are not
liable for any damages, liability or losses arising out of the use of or reliance on the services
or inability to access these services provided. Beach Belongings, Yellowbox or the location
partner may not be liable for delay or failure in performance resulting from causes beyond
Beach Belongings or Yellowbox’s reasonable control.
Beach Belongings, Yellowbox, staff of the locker location, relevant security and local or
federal patrolling agencies of the locker location reserves the right to inspect, maintain and
reallocate the locker. This includes security checks, physical inspections and/or explosive
trace detection of items stored within the lockers.

The Information We Collect

Through utilising Yellowbox as it’s Services and Applications provider, Beach
Belongings has access to the information collected by Yellowbox from users
visiting Beach Belongings locker locations.
Yellowbox collects:
• Information that you provide to Yellowbox, such as when you create your account.

• Information created when you use our services, such as location, usage and device
information.
• Information from other sources, such as Yellowbox partners and third parties that
use Yellowbox APIs.

The following information is collected by or on behalf of Yellowbox:
1. Information you provide
This may include:
• User profile: We collect information when you create or update your Yellowbox
account. This may include your name, email, phone number, password, payment or
banking information (including related payment verification information). This also
includes the preferences and settings that you enable for your Yellowbox account.
• Demographic data: We may collect demographic information about you, including
through user surveys.
• User content: We may collect information that you submit when you contact
Yellowbox customer support, or otherwise contact Yellowbox.
2. Information created when you use our services
This may include:
• Location Information
Depending your app settings or device permissions, we may collect your
precise or approximate location information as determined through data such as
GPS, IP address and WiFi.
– As a consumer of the Yellowbox service, Yellowbox collects location
information based on acquiring the location of Yellowbox’s in the vicinity.
• Transaction Information
We collect transaction details related to your use of our services, including the type of
services you requested or provided, your order details, length of service, date and
time the service was provided, amount charged, amount of free time used, and
payment method. Additionally, if someone uses your promotion code, we may
associate your name with that person.
• Usage information
We collect information about how you interact with our services. This includes
information such as access dates and times, app features or pages viewed, app
crashes and other system activity, type of browser, and third-party sites or services
you were using before interacting with our services. In some cases, we collect this
information through cookies, pixel tags, and similar technologies that create and
maintain unique identifiers.
• Device Information
We may collect information about the devices you use to access our services,
including the hardware models, device IP address, operating systems and versions,
software, file names and versions, preferred languages, unique device identifiers,
advertising identifiers, serial numbers, device motion information, and mobile network
information.
Information from other sources
These may include:
• User feedback.
• Users providing your information in connection with referral programs.
• Users requesting services for or on your behalf.
• Users or others providing information in connection with claims or disputes.

• Yellowbox business partners through which you create or access your Yellowbox
account, such as payment providers, social media services, or apps or websites who
use Yellowbox APIs or whose API Yellowbox uses.
• Publicly available sources.
• Marketing service providers.

 

Beach Belongings and Yellowbox use the information collected by Yellowbox for purposes
including:
1. Providing services and features
Yellowbox and Beach Belongings use the information we collect to provide, personalise,
maintain and improve our products and services. This includes using the information to:
• Create and update your account.
• Verify your identity.
• Enables the provision of the locker service.
• Process or facilitate payments for those services.
• Offer, obtain, provide or facilitate insurance or financing solutions in connection with
our services.
• To track the overall time of usage of the locker service
• Enable features to personalise your Yellowbox account, such as creating
bookmarks for your favourite box locations, and to enable quick access to previous
box locations.
• Perform internal operations necessary to provide our services, including to
troubleshoot software bugs and operational problems, to conduct data analysis,
testing, and research, and to monitor and analyse usage and activity trends.
2. Safety and security
We use your data to help maintain the safety, security and integrity of our services and
users. This includes, for example:
• Using device, location, profile, usage and other information to prevent, detect, and
combat fraud or unsafe activities. This includes processing of such information within
Australia, to identify practices or patterns that indicate fraud or risk of safety
incidents.
The data that we use is held within Australia, and that any data may be used in areas
outside of Australia.
3. Customer support
Yellowbox and Beach Belongings use the information collected (including recordings of
customer support calls after notice to you and with your consent) to assist you when you
contact our customer support services, including to:
• Direct your questions to the appropriate customer support person
• Investigate and address your concerns
• Monitor and improve our customer support responses
4. Research and development
We may use the information we collect for testing, research, analysis and product
development. This allows us to improve and enhance the safety and security of our services,
develop new features and products, and facilitate insurance and finance solutions in
connection with our services.
5. Communications from Yellowbox
Yellowbox & Beach Belongings may use the information collected to communicate with you
about products, services, promotions, studies, surveys, news, updates and events.

Yellowbox and Beach Belongings may also use the information to promote and process
contests and sweepstakes, fulfill any related awards, and serve you relevant ads and
content about our services and those of our business partners. You may receive some of
these communications based on your profile as a Yellowbox user.
6. Legal proceedings and requirements
We may use the information we collect to investigate or address claims or disputes relating
to your use of Yellowbox & Beach Belongings services, or as otherwise allowed by
applicable law, or as requested by regulators, government entities, and official inquiries.

 

Cookies And Third Party Technologies
Cookies are small text files that are stored on your browser or device by websites, apps,
online media, and advertisements. Yellowbox uses cookies and similar technologies for
purposes such as:
• Authenticating users
• Remembering user preferences and settings
• Determining the popularity of content
• Delivering and measuring the effectiveness of advertising campaigns
• Analysing site traffic and trends, and generally understanding the online behaviours
and interests of people who interact with our services

 

We may also allow others to provide audience measurement and analytics services for us, to
serve advertisements on our behalf across the Internet, and to track and report on the
performance of those advertisements. These entities may use cookies, web beacons, SDKs,
and other technologies to identify your device when you visit our site and use our services,
as well as when you visit other online sites and services.
You have the right to choose whether or not to accept cookies. However, they are an
important part of how our Services work, so you should be aware that if you choose to refuse
or remove cookies, this could affect the availability and functionality of the Services.
Most web browsers are set to accept cookies by default. If you prefer, you can usually
choose to set your browser to remove or reject browser cookies. To do so, please follow the
instructions provided by your browser which are usually located within the “Help” or
“Preferences” menu. Some third parties also provide the ability to refuse their cookies
directly by clicking on an opt-out link, and we have indicated where this is possible in the
table below.


Information Sharing And Disclosure
Yellowbox & Beach Belongings may share the information we collect:
1. With other users
This includes sharing the users first name, last name, phone number and locker location with
another user during the transfer of locker access.
2. At your request;
This includes sharing your information with:
• Yellowbox and Beach Belongings business partners For example, if you
requested a service through a partnership or promotional offering made by a third party,
Yellowbox and Beach Belongings may share your information with those third parties. This
may include, for example, other apps or websites that integrate with our APIs, services, or
those with an API or service with which we integrate, or business partners with whom
Yellowbox may partner with to deliver a promotion or a specialised service.
3. With the general public when you submit content to a public forum

Through the public posting on our various online network channels. When you communicate
with us through those channels, your communications may be viewable by the public.
4. With Yellowbox and Beach Belongings subsidiaries and affiliates
We share information with our subsidiaries and affiliates to help us provide our services or
conduct data processing on our behalf.
5. With Yellowbox & Beach Belongings service providers and business partners
Yellowbox may provide information to its vendors, consultants, marketing partners, research
firms, and other service providers or business partners. This may include, for example:
• Payment processors and facilitators.
• Cloud storage providers.
• Marketing partners and marketing platform providers.
• Data analytics providers.
• Research partners, including those who act under Yellowbox’s behalf
• Vendors that assist Yellowbox to enhance the safety and security of its apps.
• Consultants, lawyers, accountants and other professional service providers.
• Insurance and financing partners.
• Location partners, including venue security, facility managers, service staff and IT
staff.
6. For legal reasons or in the event of a dispute
Yellowbox and Beach Belongings may share your information if we believe it is required by
applicable law, regulation, operating agreement, legal process or governmental request, or
where the disclosure is otherwise appropriate due to safety or similar concerns.
This includes sharing your information with law enforcement officials, government
authorities, insurance providers, or other third parties as necessary to enforce our Terms of
Service, user agreements, or other policies, to protect Yellowbox & Beach Belongings’ rights
or property or the rights, safety or property of others, or in the event of a claim or dispute
relating to your use of our services. If you use another person’s credit card, we may be
required by law to share information with that credit card holder, including the transaction
information.
7. With your consent
Yellowbox and/or Beach Belongings may share your information other than as described in
this policy if we notify you and you consent to the sharing.
Information Retention And Deletion
Yellowbox requires user profile information in order to provide its services, and retains such
information for as long as you maintain your Yellowbox account.
Once such information is no longer necessary to provide Yellowbox services, enable
customer support, enhance the user experience or other operational purposes, Yellowbox
takes steps to prevent access to or use of such information for any purpose other than
compliance with these requirements or for purposes of safety, security and fraud prevention
and detection.
You may request deletion of your account at any time through the settings in the Yellowbox
application.
Following such request, Yellowbox deletes the information that it is not required to retain. In
certain circumstances, Yellowbox may be unable to delete your account, such as if there is
an outstanding credit on your account or an unresolved claim or dispute. Upon resolution of
the issue preventing deletion, Yellowbox will delete your account as described above.
Yellowbox & Beach Belongings may also retain certain information if necessary for its
legitimate business interests, such as fraud prevention and enhancing users’ safety and

security. For example, if Yellowbox shuts down a user’s account because of unsafe
behaviour or security incidents, Yellowbox and Beach Belongings may retain certain
information about that account to prevent that user from opening a new account in the future.


Choice And Transparency
A. PRIVACY SETTINGS
The Privacy Settings menu in the Yellowbox app gives users the the ability to update their
location, and their preferences for receiving mobile notifications from Yellowbox. Information
on these settings, how to set or change these settings, and the effect of turning off these
settings are described below.
• Location Information
o Yellowbox uses the consumers device location services to make it easier to
find a particular locker location. Location data also helps improve our services,
including pickups, navigation, and customer support.
o You may enable/disable, or adjust, Yellowbox’s collection of location
information at any time through the Privacy Settings menu in the app, or via the
settings on your mobile device. If you disable the device location services on your
device, your use of the Yellowbox app will be affected.
• Notifications: Account and Service Updates
o Yellowbox will provide users with notifications and updates related to your
service. These notifications are a necessary part of using the Yellowbox app, and
cannot be disabled. However, you may choose the method by which you receive
these notifications through the Privacy Settings menu in the Yellowbox app.
• Notifications: Discounts and News
o You may enable Yellowbox to send you push notifications about discounts
and news from us. You may enable/disable these notifications at any time through
the Privacy Settings menu in the Yellowbox app.


B. DEVICE PERMISSIONS
Most mobile platforms (iOS, Android, etc.) have individual types of device data that apps
cannot access without your consent. And these platforms have different permission systems
for obtaining your consent. The iOS platform will alert you the first time the Yellowbox app
wants permission to access certain types of data and will let you consent (or not consent) to
that request. Android devices will notify you of the permissions that the Yellowbox app seeks
before you first use the app, and your use of the app constitutes your consent.


C. USER DATA REQUESTS
You may request:
• Accessing data: Users can ask for an explanation of the data we collect from them
and how we use it.
• Receiving data: Users can ask for a copy of data that Yellowbox collects from them
with their consent or as necessary to provide our services.
• Changing or updating data: Users can edit the name, phone number, email address
and payment method through the account settings and wallet in the Yellowbox app
menu. They may also ask that Yellowbox change or update their data, including if
they believe such data is inaccurate or incomplete.
• Deleting data: Users may request deletion of their account at any time through
account settings in the Yellowbox app menu.
• Objections, restrictions, and complaints: Users may request that we stop using all or
some of their personal data, or that we limit use of their data. Yellowbox may

continue to process data after such objection or request to the extent required or
permitted by law.
If you make a request, we have a month to respond to you. If you would like to exercise any

In addition, depending on their location, users have the right to file a complaint relating to
Yellowbox’s handling of their personal data with the data production authority in their country.


Updates To This Policy
We may occasionally update this policy. If we make significant changes, we will notify you of
the changes through the Yellowbox app or through other methods of communication. To the
extent permitted under applicable law, by using our services after such notice, you consent
to our updates to this policy.
It is important to review this policy regularly for information regarding these practices.
Previous versions of the policies are also able to be reviewed.
